UPDATE: Mother of one-month-old taken from hospital is in custody

AUSTIN- Brittany Sadi Smith, 30, mother of one-month-old baby Elijah who was taken from an Austin hospital shortly after birth, is now in police custody.

According to the U.S. Marshals, Texas’ Lone Star Fugitive Task Force, Smith was apprehended Thursday, August 15th, at 5606 Springdale Road in Austin.

Officials state Smith has a criminal history of child abuse and injury, allowed the newborn to leave the hospital with a woman she stated was her sister, later facts revealed that woman was Smith’s cousin, Brand Philips.

Investigators questioned both Smith and the father of Smith’s other children, Carl Hayden.

According to Austin Police, neither Smith or Hayden would cooperate with CPS.

Smith unexpectedly checked out of the hospital against all medical advice.

Smith’s arrest warrant listed interference with child custody, following the statewide Amber Alert for one-month-old baby Elijah Philips earlier that week.

U.S. Marshals stated Smith “avoided law enforcement presence and commands from outside the residence and remained inside momentarily,” before surrounding.

Smith was taken into custody and transported to the Travis County Jail.
